Terms and Conditions

Foreword

Travel Afrique operates an online platform, primarily at travelafrique.com. Customers ("Customers", "Customer", "Members", "Member") can book travel and other travel-related services ("Services", "Service") through carefully selected service providers ("Service Providers", "Service Provider") (e.g. travel agencies, hotels, etc.) via this platform. When booking a Service, the contract is concluded between the customer and the Service Provider mediated by Travel Afrique.

1. Scope of Application

General Terms and Conditions

The General Terms and Conditions ("Terms" or "Terms and Conditions") apply to all legal transactions concluded via the platform. Travel Afrique reserves the right to change these Terms at any given time. The version of these Terms which is valid at the time of the order and which cannot be changed unilaterally shall be decisive in each case. Conflicting or deviating conditions of the customer will not be recognized.

2. Scope of Services

The Travel Afrique platform allows registered users to book travel services from selected Service Providers. The Service Provider may offer accommodation services, catering services, provision of one or more day activities in various categories such as multi-day excursions or experiences, access to events, and a variety of other travel-related and non-travel-related services.

Relationship between Travel Afrique and Service Providers

If you join Travel Afrique as a Service Provider, your relationship with Travel Afrique is limited to being an independent Service Provider and not an employee, agent, co-owner of Travel Afrique. You are acting solely on your own behalf and for your own benefit and are not authorized to act, speak or represent on behalf of Travel Afrique if not approved or indicated by Travel Afrique. Travel Afrique has not and will not generally direct or control you or your performance under these Terms, including in connection with the provision of the Services. You acknowledge and agree that whether you choose to provide Services on the Platform or otherwise engage in business or professional activities is at your sole discretion.

Use of Users Content

In order to promote the Travel Afrique platform and increase the exposure of offers and Services to potential Customers, offers and services and content may be displayed on other websites, in applications, in emails, and in online and offline advertisements. To support Members who speak different languages, offers and other content may be translated in whole or in part into other languages. Travel Afrique cannot guarantee the accuracy or quality of such translations, and Members are responsible for checking and verifying the accuracy of such translations. Travel Afrique's platform may include translations created by Google Translate or other translation services.

Liability for External Content and Links

The Travel Afrique Platform may contain links to third-party websites or resources. Such third-party Services may be subject to different Terms and Conditions and privacy practices. Travel Afrique is not responsible or liable for the availability or accuracy of such third-party services or the content, products or services available through such third party services. Links to such third-party services do not constitute an endorsement of such third-party services by Travel Afrique.

Availability and Accessibility

Due to the nature of the Internet, Travel Afrique cannot guarantee the continuous and uninterrupted availability and accessibility of the Travel Afrique Platform. Travel Afrique may limit the availability of the Travel Afrique Platform or certain areas or features thereof if necessary due to capacity constraints, the security or integrity of our servers, or to perform maintenance to ensure the proper or improved functioning of the Travel Afrique Platform. Travel Afrique may improve, enhance and modify the Travel Afrique Platform and introduce new services and features from time to time.

3. Authorization, Use of the Travel Afrique Platform, Member Verification

In order to access and use the Travel Afrique Platform or register a Travel Afrique Account, you must be a person who is at least 18 years of age or a duly organized, validly existing corporation, organization or other legal entity known and capable of entering into legally binding contracts according to the laws of the country in which you are located.

You will comply with all applicable export control laws in your local jurisdiction. You further represent and warrant that (i) neither you nor your Services are located or operate in any country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and (ii) you are not on any U.S. government list of prohibited or restricted parties.

Travel Afrique may make access to the Travel Afrique Platform or certain areas or features of the Travel Afrique Platform subject to certain conditions or requirements, such as completion of a verification process, meeting certain quality or eligibility criteria, meeting rating or verification thresholds, or a Member's booking and cancellation history.

4. Modification of these Terms and Conditions

Travel Afrique reserves the right to modify these Terms at any time in accordance with this provision. Upon making changes to these Terms, we will post the revised Terms on the Travel Afrique platform and update the "Last Updated" date at the top of these Terms. We will also notify you by email at least thirty (30) days before the effective date of the changes. If you do not agree with the revised Terms, you may terminate this Agreement effective immediately. We will inform you of your right to terminate the Agreement in the notification email. If you do not terminate your Agreement prior to the effective date of the revised Terms, your continued access to or use of the Travel Afrique Platform will be deemed to be your implied acceptance of the revised Terms.

5. Account Registration

You must first register an account in order to access and use certain features of the Travel Afrique Platform. When you register a Travel Afrique account for a business, organization or other entity, you represent and warrant that you have the authority to bind that entity and to grant us all permissions and licenses provided for in these Terms.

You must provide accurate, current and complete information upon registration and keep your Travel Afrique account and Travel Afrique public profile pages up to date.

You may not register more than one (1) Travel Afrique account unless Travel Afrique authorizes you to do so. You may not assign or otherwise transfer your Travel Afrique account to another party.

You are responsible for maintaining the confidentiality and security of your Travel Afrique Account registration information and may not disclose your registration information to any third-party. You must notify Travel Afrique immediately if you know or have reason to believe that your registration data has been lost, stolen, misappropriated or otherwise compromised, or if you have actual or suspected unauthorized use of your Travel Afrique Account. You are responsible for all activities conducted through your Travel Afrique Account unless such activities were not authorized by you and you were not otherwise negligent (e.g., failure to report unauthorized use or loss of your access data).

No third-party is authorized by Travel Afrique to ask for your access data, and you may not ask for another member's access data.

6. Service Fees

Travel Afrique may charge fees to Service Providers and/or Customers who book these Services with Service Providers through the use of the Travel Afrique Platform.

7. Booking Services

Your Details

In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. Failure to provide requested details may result in additional charges, limited experience of your booked Services and non-refundable cancellation of your trip or Services.

Acceptance of Booking

If we accept your booking we will issue a confirmation via email. A contract will exist between you and the Service Provider from the date we issue the confirmation.

8. Governing Law

These Terms shall be governed by the laws of Zurich, Switzerland, without respect to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between us with respect to our Service and supersede all prior agreements between us with respect to the Service.
